Homeowner Agreement

This page covers the parts of using LawnSwap that apply to homeowners. It is a supplement to our Terms of Service, which apply to you in full and control if the two ever conflict. Nothing here is a separate contract for lawn care. Your contract for the actual work is with the landscaper you choose.

1. It is free, and we mean free

1.1. Posting your property, running an AI lawn estimate, receiving sealed bids, and choosing a landscaper cost you nothing. There is no subscription, no membership, no reveal fee, and no commission taken from you today. LawnSwap collects no payment through the platform at all.

1.2. We intend to charge for LawnSwap eventually. We have not set the price. Before the first job books through the platform we will publish our full pricing on the site, and no fee will apply to you without at least thirty (30) days' notice. See Section 6.2 of the Terms and our Refund Policy.

1.3. You pay your landscaper directly, on terms the two of you agree. LawnSwap does not process that payment, does not hold it in escrow, and takes no share of it.

2. How the bidding works for you

2.1. You post a listing describing the work you want and a window for bids. Landscapers whose service area covers your neighborhood are notified and can submit a sealed per-visit price.

2.2. Bids are sealed. Landscapers cannot see each other's prices, so each one bids against your job rather than against a number on a screen.

2.3. You are never obligated to choose anyone. If none of the bids work for you, let the window close and nothing happens.

2.4. LawnSwap does not offer reviews, star ratings, or any scoring of landscapers. If you see a claim anywhere suggesting we do, it is wrong. You are comparing price and the business details each landscaper has given us, and we encourage you to ask for references directly.

3. Your address stays private until you choose

3.1. Before you pick a winner, no landscaper on the platform has your name, phone number, email address, or exact street address. The alerts we send them about your listing identify the area by zip code only, and the map they see shows an approximate location, not your house.

3.2. This is how we have built the product and how we intend to keep it. It is not a security guarantee, and it does not stop a landscaper from guessing or from learning your address some other way. See Section 14 of the Terms and our Privacy Policy.

3.3. Landscapers are prohibited from contacting you before you have chosen them. If one does, tell us at lawnswapai@gmail.com.

4. Choosing a landscaper cannot be undone

4.1. When you select a winning bid, we ask you to confirm twice and we tell you before you confirm that the choice is permanent. Read that screen.

4.2. Once you confirm, three things happen at once and none of them can be reversed: the landscaper you picked receives your name, phone number, email address, and property address; your listing closes; and the other bids are withdrawn and the other landscapers are told the job is taken.

4.3. LawnSwap cannot un-send your address, re-open a closed listing, or bring back a bid you did not pick. If the arrangement does not work out, you can post a new listing at any time at no charge.

4.4. Choosing a landscaper is an introduction, not a booking. It does not schedule anything, does not obligate the landscaper to take the job, and does not create any agreement between you and LawnSwap for lawn care. Everything after the introduction is arranged between you and the landscaper.

5. The AI estimate is a recommendation

Our AI estimate measures your lawn from public parcel records and aerial imagery and suggests a price range. It is a recommendation generated by software, not a quote, an appraisal, or an offer. The imagery can be years old and the measurement can be wrong. No landscaper is bound by it, the real price is set by the landscaper and confirmed on the first visit, and you should not rely on the estimate as a final price. See Section 5.4 of the Terms.

6. What LawnSwap does not do

6.1. We do not perform lawn care. Every landscaper on LawnSwap is an independent business, not our employee, contractor, agent, or representative. We do not send them, supervise them, schedule them, inspect their work, or control how they do it.

6.2. We do not guarantee the work. There is no LawnSwap service guarantee, no re-match promise, and no damage fund. If a landscaper does not show up, does the job badly, or damages your property, that is a matter between you and that business, and your remedies are against them.

6.3. Our verification is a document check. We ask landscapers to represent that they are licensed and insured and to send us supporting documents, and a person reviews what they send. That is the whole of it. We do not run criminal background checks, do not confirm documents with the issuing agency, do not inspect equipment or job sites, and do not assess anyone's skill. Where the site says a landscaper is verified, that is what the word means here. Confirm licensing and insurance yourself before you let anyone start work. See Section 8 of the Terms.

6.4. Some work needs a permit, and getting it is the landscaper's responsibility. Tree removal and heavy pruning in Coral Gables, for example, generally require a City permit. Ask to see it before tree work starts.

7. What we ask of you

  • Own the property, or have the owner's permission to have work done on it.
  • Describe the job accurately. A listing that understates the work leads to bids that get revised on the first visit.
  • Give the landscaper access on the day, and say up front if there is a gate, a dog, or an irrigation system.
  • Pay the landscaper what you agreed. If you dispute it, take it up with them.
  • Do not use another user's contact details for anything other than the job you arranged.

9. Your account and your data

9.1. You can delete your account and your personal data yourself, at any time, from your account page. You do not have to email us or wait for approval.

9.2. Deleting your account does not reach backward: a landscaper you already chose still has the contact details we sent them at that moment, and we cannot retrieve those. It also does not erase the limited records we are required to keep. Our Privacy Policy lists what is kept and for how long.

10. Disputes and governing law

10.1. A dispute about the actual lawn work is between you and the landscaper. Tell us anyway. We may contact the business, and a landscaper who repeatedly fails homeowners can lose the account. That is enforcement of our rules, not a promise of any outcome or payment to you.

10.2. A dispute with LawnSwap itself is governed by Section 17 of the Terms, which requires you to contact us first and then, if that fails, resolves most disputes by individual arbitration and waives class actions, subject to a 30-day right to opt out and a small-claims exception. Read it.

10.3. These terms are governed by Florida law, and any dispute not subject to arbitration belongs in the state or federal courts in Miami-Dade County, Florida. Nothing here waives any right you have under the Florida Deceptive and Unfair Trade Practices Act.
